  • The Legal Team of the Future: Law+ Skills

    02
The legal profession needs more than law. Whether you are a student, a law school, a university, a law firm or an in-house legal team, The Legal Team of the Future is the definitive guide to understanding and building the holistic skills required of those working in legal services now and in the future. Highlighting the importance of multidisciplinary teams working collaboratively to solve legal problems, the book introduces a ‘Law+’ model for the profession, comprising sixteen skills across four quadrants: Law+People, Law+Business, Law+Change and Law+Technology. As well as outlining each of the skills, the book explains how to build those skills as an individual, a law firm, an in-house team, a university or a law school. Designed for both lawyers and business professionals working in law, The Legal Team of the Future dispels the myth that the ‘lawyer of the future’ is solely responsible for the future of the profession, instead focusing on diverse individuals working within their own specializations. The Law+ model is more than an academic theory, containing real-world examples and case studies and devised by an expert in legal innovation who is still working in the field on a daily basis. This book is the guide you need to navigate the future of the legal profession and to stay ahead of the pack in delivering legal services to clients.

  • Legal Writing in Plain English, Third Edition: A Text with Exercises (Chicago Guides to Writing, Editing, and Publishing)

The leading guide to clear writing—and clear thinking—in the legal profession for more than two decades, now newly updated.

Admirably clear, concise, down-to-earth, and powerful—all too often, legal writing embodies none of these qualities. Its reputation for obscurity and needless legalese is widespread. Since 2001, Bryan A. Garner’s Legal Writing in Plain English has helped address this problem by providing lawyers, judges, paralegals, law students, and legal scholars with sound advice and practical tools for improving their written work. Now the leading guide to clear writing in the field, this indispensable volume encourages legal writers to challenge conventions and offers valuable insights into the writing process: how to organize ideas, create and refine prose, and improve editing skills.

Accessible and witty, Legal Writing in Plain English draws on real-life writing samples that Garner has gathered through decades of teaching experience. Trenchant advice covers all types of legal materials, from analytical and persuasive writing to legal drafting, and the book’s principles are reinforced by sets of basic, intermediate, and advanced exercises in each section.

For this third edition, Garner has retained the structure of the previous versions, with updates and new material throughout. There are new sections on making your writing vivid and concrete and on using graphics to enhance your argument. The coverage and examples of key topics such as achieving parallelism, avoiding legalese, writing effective openers and summaries, and weaving quotations into your text have also been expanded. And the sample legal documents and exercises have been updated, while newly added checklists provide quick summaries of each section.

Altogether, this new edition will be the most useful yet for legal professionals and students seeking to improve their prose.

  • The Laws of Restitution

In The Laws of Restitution, Robert Stevens shows that there is no unified law of restitution or unjust enrichment. Instead, there are seven or eight different kinds of private law claim, depending on how you count them, which have nothing important in common one with another that have been grouped together by commentators. Few of these claims have anything to do with enrichment, and what is restituted differs between them. Like all private law claims, those gathered here concern (in)justice between individuals, but they have no further unity. Many of them are not based upon an agreement or a wrong, but that negative feature has no utility. “Restitution” or “unjust enrichment’ should cease to be discussed as unified areas of law.

With close attention to caselaw and legislation, the work identifies and describes the various reasons for “restitution” that any properly constructed system of private law ought to recognise. It explains how the law of restitution relates to, and is bound up with, contract, torts, equity, and property law.

This unique book provides readers with a concise yet rigorous outline of the English corporate insolvency framework as it is practised in domestic and cross-border cases. In doing so, this primer provides clear and accessible guidance on what is often considered to be a highly technical subject.

What happens when a company is liquidated or restructured, but has assets and creditors in England and abroad? • Public Law

Fresh, modern, and practical, Public Law provides law undergraduates with a unique approach to constitutional and administrative law, aptly demonstrating why this is an exciting time to be studying the subject.

Writing in a fluid, succinct style, the authors carve a logical pathway through the key areas studied on the LLB, guiding students to a solid understanding of the fundamental principles. This theoretical grounding is then rooted in reality, with each concept applied to a hypothetical scenario (included at the start of each chapter) to set it into a practical context.

While this practical element helps students to understand how the law applies and develop problem-solving skills, a trio of supportive learning features also encourages active engagement with and a critical appreciation of public law. ‘Key case’ boxes highlight and analyse the significant case law in each area; ‘Counterpoint’ boxes flag alternative viewpoints and areas of debate; and ‘Pause for reflection’ boxes prompt readers to consider the impact of laws, and what potential developments and reforms may lie ahead.

Public Law’s modern approach and unique combination of practical application and theoretically critical discussion makes it the ideal choice for students seeking to understand concepts not only in the abstract but in practice, helping them to develop the skills they need to succeed at university and beyond.

  • Law in Northern Ireland

    01
This textbook presents an engaging and thorough examination of the law in Northern Ireland.

It guides students through the evolution of law-making, the legislative process, courts, and case law and presents a clear overview of the fundamental rules and principles of international law, public law, criminal law, and private law.

It contextualises the myriad legal institutions operating in the jurisdiction, sets out how criminal and civil proceedings work in practice, and provides useful information on how people become lawyers, what lawyers actually do once they become qualified, and how the legal system is funded. The appendices set out sample sources of law so that readers can familiarise themselves with what is involved in handling legal documents.

This edition has been updated following recent legal developments in Northern Ireland including the ‘New Decade, New Approach’ agreement of 2020 and the different elements of the power-sharing government, such as the proposed Languages Bill and the Northern Ireland (Ministers, Elections and Petitions of Concern) Bill. It explains the effect of Brexit, in particular the new concept of ‘retained EU law’ and the effect of the Ireland / Northern Ireland Protocol to the EU-UK Withdrawal Agreement.

Setting out the implications of the recent UK-wide reviews of administrative law and the Human Rights Act for Northern Ireland, the book examines the work of the shadow Civil Justice Council and Family Justice Board and looks at the latest developments in the reform of abortion law. It explores new Assembly legislation that addresses the use of committal proceedings in criminal cases, the protection afforded to victims of domestic violence, and the rights of other victims, for example in relation to compensation for victims and survivors of the troubles and the appointment of an interim Victims of Crime Commissioner.

  • Great Debates in Land Law (Great Debates in Law)

While there are plenty of land law textbooks on the market, there is, in general, an absence of critical texts designed for law students to deepen their understanding of the subject. Great Debates in Land Law provides students with the contextual and critical aspects of this exciting topic. Each chapter introduces topics for debate such as “Is tenancy a property or a personal right?” and goes on to include features such as boxed discursive notes from the authors, important cases and suggestions for further reading.

The Great Debates series provides engaging and accessible analysis of the more advanced legal concepts. For books in the major taught subjects, such as land law, the series is designed for use by ambitious students alongside a main course textbook. For books addressing subjects that are less often taught (such as family law), the series provides a clear and critical exposition of the key areas of debate. By focussing on particular questions and tensions underlying a subject, Great Debates titles encourage students to think critically, analyse a topic and gain additional insights. These skills and the discursive nature of the series, with an emphasis on contentious topics, are also useful for students when preparing their dissertations.
