The law is, indeed, all around us – and this book will whet your appetite to find out how and why.” – Alex Wade, The Times Law is one of the few subjects that the school leaver, choosing a degree course, will have very little real understanding of. This book comes to the rescue by clearly setting out what a prospective law student can expect and why a student should choose to study law. This new edition is updated to reflect the reality of studying law today, highlighting changes due to Brexit and reforms to constitutional law. Competitive Processes, Terms, and Conditions for Leasing Public Lands for Solar and Wind Energy Development (US Bureau of Land Management Regulation) (BLM) (2018 Edition) The Law Library presents the complete text of the Competitive Processes, Terms, and Conditions for Leasing Public Lands for Solar and Wind Energy Development (US Bureau of Land Management Regulation) (BLM) (2018 Edition). Updated as of May 29, 2018 Through this final rule the Bureau of Land Management (BLM) is amending its regulations governing rights-of-way issued under the Federal Land Policy and Management Act (FLPMA) and the Mineral Leasing Act (MLA). The principal purposes of these amendments are to facilitate responsible solar and wind energy development on BLM-managed public lands and to ensure that the American taxpayer receives fair market value for such development. This final rule includes provisions to promote the use of preferred areas for solar and wind energy development, called “designated leasing areas” (DLAs). It builds upon existing regulations and policies to expand BLM’s ability to utilize competitive processes to offer authorizations for development inside or outside of DLAs. It also addresses the appropriate terms and conditions (including payment and bonding requirements) for solar and wind energy development rights-of-way issued under the regulations. Finally, the rule makes technical changes, corrections, and clarifications to the existing rights-of-way regulations. Some of these changes affect all rights-of-way, while some provisions affect only specific rights-of-way, such as those for transmission lines with a capacity of 100 kilovolts (kV) or more. This book contains: – The complete text of the Competitive Processes, Terms, and Conditions for Leasing Public Lands for Solar and Wind Energy Development (US Bureau of Land Management Regulation) (BLM) (2018 Edition) – A table of contents with the page number of each section

  • Legal Writing in Plain English, Third Edition: A Text with Exercises (Chicago Guides to Writing, Editing, and Publishing)

The leading guide to clear writing—and clear thinking—in the legal profession for more than two decades, now newly updated.

Admirably clear, concise, down-to-earth, and powerful—all too often, legal writing embodies none of these qualities. Its reputation for obscurity and needless legalese is widespread. Since 2001, Bryan A. Garner’s Legal Writing in Plain English has helped address this problem by providing lawyers, judges, paralegals, law students, and legal scholars with sound advice and practical tools for improving their written work. Now the leading guide to clear writing in the field, this indispensable volume encourages legal writers to challenge conventions and offers valuable insights into the writing process: how to organize ideas, create and refine prose, and improve editing skills.

Accessible and witty, Legal Writing in Plain English draws on real-life writing samples that Garner has gathered through decades of teaching experience. Trenchant advice covers all types of legal materials, from analytical and persuasive writing to legal drafting, and the book’s principles are reinforced by sets of basic, intermediate, and advanced exercises in each section.

For this third edition, Garner has retained the structure of the previous versions, with updates and new material throughout. There are new sections on making your writing vivid and concrete and on using graphics to enhance your argument. The coverage and examples of key topics such as achieving parallelism, avoiding legalese, writing effective openers and summaries, and weaving quotations into your text have also been expanded. And the sample legal documents and exercises have been updated, while newly added checklists provide quick summaries of each section.

Altogether, this new edition will be the most useful yet for legal professionals and students seeking to improve their prose.

  • Buying Silence: How oligarchs, corporations and plutocrats use the law to gag their critics

    01

***BOOK OF THE YEAR 2023, THE SPECTATOR***

    “Masterful” Tom Bower

    “Vital” Graydon Carter

    “Shocking” Baroness Helena Kennedy

THE ERA OF WIN AT ALL COSTS, WHETHER LEGAL OR ILLEGAL , IS UPON US. THIS IS THE ERA OF THE SLAPP CASE.

Strategic Lawsuits Against Public Participation, or SLAPPs, are designed to censor, intimidate and silence critics of the powerful and wealthy by burdening them with aggressive opposing lawyers, heavy legal costs and deeply intrusive – and sometimes illegal – private investigations until they abandon the case.

The UK has the unenviable accolade of being the number one destination for such cases. Billionaire oligarchs, often ex-convicts and linked to organised crime, come here to launder their reputations through suing for libel – even when what’s been written about them is entirely true. Even worse, more often than not they either win their cases or scare their opponents into self-censorship, in a devastating blow to investigative journalism, media freedom and the public interest.

In this timely, insightful and often shocking book, David Hooper, veteran media lawyer, explores how the power of money enables the very wealthy – including Robert Maxwell, Nadhim Zahawi and McDonald’s – to crush their critics through SLAPP tactics. From billionaire oligarchs to powerful corporations, from corrupt politicians to super-rich businesspeople, Hooper describes how those with something to hide tried to stop you knowing about it, how their lawyers were willing to help them and – most importantly – what the government urgently needs to do to stop them.

Setting out the implications of the recent UK-wide reviews of administrative law and the Human Rights Act for Northern Ireland, the book examines the work of the shadow Civil Justice Council and Family Justice Board and looks at the latest developments in the reform of abortion law. It explores new Assembly legislation that addresses the use of committal proceedings in criminal cases, the protection afforded to victims of domestic violence, and the rights of other victims, for example in relation to compensation for victims and survivors of the troubles and the appointment of an interim Victims of Crime Commissioner.

  • Breaking Law (The Return of): The Judge’s Inside Guide to Your Legal Rights & Winning in Court or Losing Well: A judge’s guide to your legal rights & winning in court or losing…

    08
Breaking Law, a judge’s inside guide to everything you need to know about your legal rights is back: bigger, better and bang up to date. Written by Stephen Gold, a civil and family judge, legal broadcaster and journalist, this self-help best-seller has been significantly expanded with over 25 new chapters added to make this a 77 chapter bumper second edition covering even more of the legal problems we may all encounter at some time in our lives. So whoever you are – litigant in person, consumer or business owner and you can even be a professional lawyer or legal trainee to derive benefit from the book – you will find entertaining and enormously practical advice, written in straightforward language, direct from the judge’s pen to help you succeed in your dispute – or at least lose well. Been overcharged at a supermarket? Overlooked in a relative’s will? Sold duff goods? Sued for repossession by mortgage lender or landlord? Threatened by being left penniless after a divorce? You can find help here. But now in this second edition, you will also be armed to challenge that parking ticket, cope with a speeding or drink-drive prosecution, get your money back on a Covid cancelled holiday, resist excessive service charges from your landlord and much, much more. And Breaking Law Iooks like being the first book available to cover the new no-fault divorce laws that are due to come into force in April 2022. But Stephen does much more than explain rights. He takes you through how to behave in court (including how to cross-examine) whether it’s a face-to-face or remote hearing. And the book is full of templates: letters to help you win without a court case; documents you can use if the dispute goes to court; and documents such as the change your name deed, the cohabitation agreement, the pre-nuptial agreement, the anti-gazumping agreement, the no-sex agreement and the longest will in the world from which you can chose who inherits and who doesn’t. Throughout, Stephen’s advice is illuminated by tales of how his own disputes with a myriad of businesses have gone. No disputes with the twins Ron and Reg Kray, though. He was their lawyer and there’s a fascinating account of his professional relationship with them and his discovery of what became of Ron’s brain. If you do think you need a lawyer, Stephen provides plenty of ideas of how to get legal advice before handing over any money along with how to source professional help in and out of courts and tribunals for those who cannot afford legal fees (and who can?!). From the moment you get out of bed, you could suddenly find yourself needing this book. So don’t wait till the worst happens, get a copy and keep it handy like thousands of others have done over the last five years.

  • Mental Capacity Act 2005 Code of Practice: Code of practice giving guidance for decisions made under the Mental Capacity Act 2005

    01
Mental Capacity Act 2005 Code of Practice Code of practice giving guidance for decisions made under the Mental Capacity Act 2005 Details: The Mental Capacity Act 2005, covering England and Wales, provides a statutory framework for people who lack capacity to make decisions for themselves, or who have capacity and want to make preparations for a time when they may lack capacity in the future. It sets out who can take decisions, in which situations, and how they should go about this. The Act received Royal Assent on 7 April 2005 and will come into force during 2007. The legal framework provided by the Mental Capacity Act 2005 is supported by this Code of Practice (the Code), which provides guidance and information about how the Act works in practice. Section 42 of the Act requires the Lord Chancellor to produce a Code of Practice for the guidance of a range of people with different duties and functions under the Act. Before the Code is prepared, section 43 requires that the Lord Chancellor must have consulted the National Assembly for Wales and such other persons as he considers appropriate. The Code is also subject to the approval of Parliament and must have been placed before both Houses of Parliament for a 40-day period without either House voting against it. This Code of Practice has been produced in accordance with these requirements. The Code has statutory force, which means that certain categories of people have a legal duty to have regard to it when working with or caring for adults who may lack capacity to make decisions for themselves.

  • Great Debates in Land Law (Great Debates in Law)

While there are plenty of land law textbooks on the market, there is, in general, an absence of critical texts designed for law students to deepen their understanding of the subject. Great Debates in Land Law provides students with the contextual and critical aspects of this exciting topic. Each chapter introduces topics for debate such as “Is tenancy a property or a personal right?” and goes on to include features such as boxed discursive notes from the authors, important cases and suggestions for further reading.

The Great Debates series provides engaging and accessible analysis of the more advanced legal concepts. For books in the major taught subjects, such as land law, the series is designed for use by ambitious students alongside a main course textbook. For books addressing subjects that are less often taught (such as family law), the series provides a clear and critical exposition of the key areas of debate. By focussing on particular questions and tensions underlying a subject, Great Debates titles encourage students to think critically, analyse a topic and gain additional insights. These skills and the discursive nature of the series, with an emphasis on contentious topics, are also useful for students when preparing their dissertations.
