Clinical Negligence claims currently cost the NHS over £2 billion every year. Litigation is time-consuming, expensive and stressful for all involved. For those whose lives have been changed dramatically as a result of negligent medical treatment, bringing a claim may be the only means of obtaining redress for the harm done to them. But the process of litigation can be a bewildering and sometimes hostile experience. For many healthcare professionals the fear of litigation is a real concern and there is deep anxiety that litigation contributes to an unhealthy, even dangerous culture of blame. Clinical Negligence Made Clear: A Guide for Patients and Professionals is an attempt by one the country’s leading clinical negligence practitioners to help all those who might be affected by such cases to understand what is involved and thereby to reduce the cost and emotional impact of clinical negligence litigation. In concise, accessible language Nigel Poole QC charts how clinical negligence has evolved, its place within the justice system and how compensation is assessed explains ten core legal principles of clinical negligence such as the doctor’s duty of care and the standards expected of healthcare professionals sets out how a claim proceeds and what happens before and during a trial focuses on specific common areas of clinical negligence claims such as wrongful birth, delays in cancer treatment and cosmetic surgery looks to the future and asks whether the current system is sustainable The aim is to provide an intelligent but accessible guide for patients, doctors, nurses, therapists, expert witnesses, and healthcare managers so that those caught up in legal proceedings have a realistic view of the impact they will have and a clearer understanding of when a dispute might be best resolved early. No doubt it will also provide a lively introduction to the subject for students, trainees and lawyers looking to move into clinical negligence work.

This book ‘does what it says on the tin’ and demystifies clinical negligence and the laws that surround it.
It was originally purchased for my wife who was studying for a medicolegal exam—she got a distinction, and strongly recommended it to me, because I wanted to know more about the field, which I don’t happen to work in.
The style is pretty easy going and the content covers all the things you’d want to know about, like definitions of negligence, the legal basis, Bolam, Bolitho, and the practicalities of going through a claim. The book is pretty up to date with a detailed section on Dr Bawa-Garba.
It seems a useful text for people in the medicolegal field, those whose work touches on medicolegal aspects (like many healthcare professionals ) and I can see that it might also be useful for patients contemplating litigation.

This book is a superb guide which achieves what it sets out to do. It explains in lay term the intracacies of clinical negligence law but includes lot of very recent case law and guidance negotiating the process with links to free documents and examples. Brilliant value and very readable.

This is a fabulous book. Written in easy to comprehend language that won’t confuse the layman.
This covers every single aspect of medical negligence from what constitutes a case, the entire process, the court process, how to and when to talk settlement and so much more.
As a law student this is a must-read as it is for any lawyer or those who need to understand it for their own personal journey. If you are fighting a medical negligence case it will help you understand clearly so much and thus make you able to communicate with your lawyer better, ask the right questions and get the best outcome and justice for yourself.
Five huge stars!

Interesting view from a barrister and legal perspective. Doesnt ring true for families going through this brutal process and misses a lot of the actual facts. I terest8ng read though.

This book should be a staple for anyone on a Medical Law module. It takes a very complicated subject and breaks it down into lucid and practical components. You gain not only an understanding of the more difficult theoretical issues such as legal causation, but the wider context in which the law operates. I work alongside my studies at a claimant-Personal Injury law firm, and the book has proved invaluable during both my work and my studies.

This is more a guide for the layman and not the lawyer. The book is described as a guide for professionals too but I think the author meant professionals other than lawyers. This book is not an academic book nor is it adequate for the practising lawyer other than a novice litigation lawyer with little experience in medical negligence claims. A lawyer who needs a medical negligence book should look for Michael Jones’ ‘Medical Negligence, 5th ed’. As a guide for the layman, this book is excellent because it is very clear and takes the reader though each step in a legal claim for medical negligence.. It is also informative about the aims of a civil action and the basis for a claim and award for damages. There is a part on particular injuries such as birth injuries and cosmetic injuries.
