The Code of Practice is a guide for people on how the Mental Capacity Act 2005 should actually work in practice. It is designed to be used as guidance for anyone who works with or cares for adults who may lack capacity to make decisions.
For certain categories of people, the Code of Practice has statutory importance. In other words, these people must follow the Code or possibly face legal sanctions and this would include healthcare staff, professional carers, police, legal professionals, and others professionally involved with someone who may lack capacity to make decisions.
The Code should also be followed by anyone who is acting as a carer for someone who lacks capacity.
The main criticism that I have for this book is that it is more suited to professional people and paid carers rather than the ordinary person who is trying to do things properly. It is written in a reference text book style which is dull, uninspiring, and quite difficult to read and comprehend. I am a professional healthcare worker, so it should appeal to me and be readily understandable. But I found it confusing and vague.
However, this book is available as a free download from the GOV.UK website, so you can have a look at it and make your mind up whether you think it is worth spending your money on.
I think it is an essential reference for the professional people and carers mentioned above, and should be available in care homes, hospitals and similar places for everyone to have access to ….. including patients and family.
